Terms of service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and PIQ LLC, a Nebraska limited liability company (“Company,” “we,” “us,” or “our”), governing your access to and use of the ProgressIQ application, website located at progressiq.app, and all related services, features, and content (collectively, the “Service”).

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE SERVICE IN ANY MANNER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.

If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms, and references to “you” include both you personally and the organization.

ProgressIQ is an AI-powered fitness tracking and progress analysis application designed for general fitness enthusiasts. The Service allows users to:

• Upload photographs of their physique for AI-assisted visual analysis
• Receive automated observations regarding body composition, muscle development, proportion balance, posture and postural alignment, and progress over time
• Track check-ins and compare progress across defined time periods
• Access goal-based observations related to fat loss, muscle gain, body recomposition, general health, and athletic performance (paid tiers)
• Receive nutritional observations and training suggestions based on uploaded photos (Pro tier only)

ProgressIQ is a general fitness tracking tool. It is NOT a medical device, clinical diagnostic tool, healthcare provider, or professional fitness coaching service. All outputs are AI-generated observations, not professional advice. See Section 10 (AI-Generated Analysis Disclaimer) and Section 11 (Health and Safety Warning) for important limitations.

• Age: You must be at least 18 years of age. If you are between 13 and 17, you may use the Service only with the documented consent and active supervision of a parent or legal guardian.
• Legal capacity: You must have the legal capacity to enter into a binding contract in your jurisdiction.
• Compliance: You must not be prohibited from using the Service under any applicable laws.
• Geographic restrictions: The Service is operated from the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws.

To access most features of the Service, you must create an account. When registering, you agree to provide accurate, current, and complete information; maintain and update your account information; maintain the security of your password; and promptly notify us at admin@physiqueiq.ai if you discover any security breach or unauthorized use of your account.

Account authentication is managed through AWS Cognito. Each account is personal to the registered user and may not be transferred, sold, or assigned without our prior written consent.

The Service is provided solely for your personal, non-commercial fitness tracking and progress monitoring purposes. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Upload content that is defamatory, obscene, pornographic, hateful, harassing, threatening, or otherwise objectionable
• Upload photos of individuals who have not provided their informed consent, or photos depicting minors
• Attempt to gain unauthorized access to any portion of the Service or any connected systems
• Use any automated system, robot, spider, or scraper to access or extract data from the Service
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Circumvent, disable, or interfere with security-related features of the Service
• Impersonate any person or entity, or falsely represent your affiliation
• Resell, sublicense, or commercially exploit any portion of the Service without our express written authorization

The Service, including its design, text, graphics, code, software, AI models, prompt systems, analysis frameworks, and all other content and materials (excluding Your Content), is the exclusive property of PIQ LLC and its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

“ProgressIQ,” the ProgressIQ logo, and related marks are trademarks or service marks of PIQ LLC. You may not use these marks without our prior written permission.

Our Privacy Policy, available at progressiq.app/privacy, describes how we collect, use, store, and share information about you when you use the Service. The Privacy Policy is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of your information as described in the Privacy Policy. We do not sell your personal information to third parties. Photo data is processed by third-party AI services (currently Anthropic) only to fulfill your analysis requests.

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless PIQ LLC and its members, managers, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or in any way related to your access to or use of the Service, your violation of these Terms, your violation of any applicable law or third-party right, or Your Content.

These Terms and any dispute arising hereunder will be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law principles. To the extent that any claim is not subject to arbitration, the parties irrevocably consent to the exclusive jurisdiction of the state and federal courts located in Douglas County, Nebraska.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Effective Date” at the top of this document and send notice to the email address associated with your account at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any revised Terms constitutes your acceptance of the revised Terms.

These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and PIQ LLC with respect to the Service and supersede all prior agreements and understandings. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
